Terms and Conditions
YOUTH MUSIC UNDERAGE COMPETITION – TERMS AND CONDITIONS
1. These are the contest rules ("Rules") and apply to The Youth Music Underage Competition unless otherwise expressly stated. By entering this Competition, entrants agree to be bound by these Rules. The Competition is organised by Youth Music, 5th Floor, One America St, London, SE1 0NE
2. To enter the competition you must register online at www.youthmusic.org.uk/underage
3. Entrants must complete the online form at www.youthmusic.org.uk/underage and upload an AUDIO / VIDEO DEMO - MAXIMUM LENGTH 4 MINUTES. You must be performing in the demo ie. singing / MCing /playing an instrument. This can be either solo or as part of a band.
4. Entries can also be submitted on CD by post. Entrants wishing to do this must download the Entry Form at www.youthmusic.org.uk/underage and complete and return this with their CD demo entry to: YOUTH MUSIC UNDERAGE COMPETITION, YOUTH MUSIC, 1 AMERICA STREET, LONDON SE1 0NE.
5. Bands/artists will be selected on merit. The decision by Youth Music and the judges is final and no correspondence will be entered into with regard to the selection process.
6. This competition is only open to individuals and bands that are UK residents (this includes the Channel Islands).
7. Entrants must be aged between 14 and 18 (includes 18) on August 2, 2009
8. If you have any problems fulfilling any of the demo competition criteria please email marketing@youthmusic.org.uk making your subject line YOUTH MUSIC WEEK UNDERAGE COMPETITION 09 and we will do our best to help.
9. Entries must be received by the closing date of 5pm on Monday 15 June 2009
10. Youth Music does not accept any responsibility for late or lost entries in any circumstances. Proof of sending or uploading cannot be accepted as proof of delivery or receipt.
11. If you are selected to be one of the winners and you are aged under 18, on August 2, 2009 your parent or guardian will be asked to complete a CONSENT FORM on your behalf.
12. Employees of Youth Music are not eligible to enter the Competition.
13. Youth Music reserves the right to verify the eligibility of all entrants. Additional evidence may be required in order to verify an entrant’s identity. This may include a valid passport or driving licence.
14. Entrants must supply full contact details as required, and comply with all rules to be eligible for the prize. No responsibility is accepted for ineligible entries.
15. Youth Music will only ever use your personal details for the purposes of administering this competition and other competitions or information on similar music, and will not publish them or provide them to anyone without your permission. 16. By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete.
17. In the case of Under 18’s, applicants must have their parents’/legal guardians’ consent to enter the Competition under these Rules.
18. By entering this contest you agree to grant Youth Music a licence to broadcast your entry across all media and online platforms under their control. This licence does not affect your moral rights and you will retain full rights in the recording and composition.
19. Youth Music reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these terms and conditions.
20. In the event that any entrant is disqualified from the Competition, Youth Music may decide whether a replacement contestant should be selected. In this event, further entrants will be selected on the same criteria as the original entrant and will be subject to these Rules.
21. Only one entry per person is allowed.
22. Competition entries must be made in the manner and by the closing date specified on the Competition Notice. Failure to do so will disqualify the entry.
23. Entrants should note that unless stated otherwise, Youth Music does not accept responsibility for the return of any Competition entries, including those consisting of artistic or other material. If return of submitted materials is requested, entrants must include an SAE with initial submission.
24. Prize winners will be notified in the manner and within the time specified on the Competition Notice. Return of any prize notification as undeliverable or failure to reply as specified in the notification within the time stated therein may result in disqualification and selection of an alternate winner.
25. Prizes are non-transferable. The prize(s) must be taken as stated and cannot be deferred. There will be no cash alternatives.
26. Youth Music cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the contest or as a result of accepting any prize.
27. Winners may be requested to take part in promotional activities. Youth Music reserves the right to use the names of winners, their photographs and audio and/or visual recordings of them in any publicity.
28. Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation by the Competition partners and will not be disclosed to a third party without the individual’s prior consent.
29. Applications received after the closing date will not be considered in the Competition.
30. Under 18’s attending the auditions and performances and subsequent recording sessions must be accompanied by a parent or guardian to and from the venue.
31. Representatives from the Competition partner organisations will be in attendance at both audition and performance days.
32. All rights in the original songs will remain the property of the original author.
33. Entries must not contain defamatory or obscene material.
34. All submissions must be completely original; no samples or work of other artists can be used unless they are royalty-free. The contest organisers accept no liability if entrants ignore this rule and entrants agree to indemnify fully Youth Music against any claims by any third party arising from any breach of this or any other rule.
35. No responsibility is accepted for ineligible, corrupt or incomplete entries or entries made fraudulently.
36. All rights in any recording or reproduction made at auditions or performances, of the music submitted and/or the performance of such music will belong to Youth Music.
37. A shortlist of entrants will be selected by the judging panel for audition. Any entrants invited to audition will be given AT LEAST 7 DAYS NOTICE.
38. Auditions will be held on Saturday 4 July (Manchester), Saturday 11 July (London), Saturday 18 July (Bristol) and Youth Music
will not reimburse travel costs to auditions.
39. A panel of judges will select the winners and a reserve list by Monday 20 July. Winners will be contacted personally by phone and by email.
40. Entrants will be deemed to have accepted these rules and to agree to be bound by them when entering this competition.
41. The panel's decision is final and no correspondence will be entered into.
42. The winners will be contacted by Tuesday 21 July. If we are unable to contact you for 3 days your prize will be deemed to be forfeited and Youth Music reserves the right to offer the prize to the runner up on the reserve list.
43. The winners must be available (with parent or guardian if under 18) to perform at the Underage Festival on Sunday 2 August, 2009.
44. The winners may be required to participate in publicity arranged by Youth Music and its partners and affiliates, and consents to allowing radio, photographs, film and TV promotional tours new media exploitation and their name to be published on the youth music website and websites of its affiliates and otherwise.
45. All entrants consent to being filmed during their performance at auditions and Underage performance (Subject to Licence).
46. Travel expenses to and from Underage Festival in London will be reimbursed for each winner/band member by Youth Music.
47. Youth Music is unable to contribute to travel expenses outside England and Wales.
48. The prize(s) must be taken as stated and cannot be exchanged or altered in any way. In the unlikely event of circumstances beyond Youth Music's control resulting in the events or performances being cancelled or postponed, Youth Music reserves the right to change the date of the event or to substitute the prize with one of equal or greater value.
49. The winner(s) may be invited to take part and co-host workshop sessions for other young people organised by Youth Music its partners or affiliates
50. These rules are governed by the laws of England and Wales.
51. Youth Music reserves the right to cancel this competition at any stage, if deemed necessary in its opinion, and if circumstances arise outside of its control
